COVID-19 Questionnaire, Attestation and Participant Agreement

Application - all BC Athletics Members (athletes, training, coaches, officials, associates) and family members (“Participants”) of those in attendance at club/training group activities.

I attest that I, or as the case may be my minor child Participant indicated below (collectively “Participant”) am not experiencing any symptoms of illness such as a fever, cough, difficulty breathing, shortness of breath or malaise (severe fatigue or feeling of being generally unwell).

If Participant develops these symptoms, I agree that Participant will leave the premises immediately and immediately informMedical Health Officer (or delegate) at your local health authority.  

I am aware that Participant must follow the safety and hygiene protocols of the Province of British Columbia, the Provincial Health Officer, the British Columbia Amateur Athletics Association, and BC Athletics Member Club/Training Group.

I attest that:

  • Participant has not travelled internationally in the past fourteen (14) days.
  • Participant has not travelled outside the Province of British Columbia in the last fourteen (14) days.
  • Participant has not travelled to an area highly impacted by COVID-19 within my Province in the past fourteen (14) days.
  • I have not and do not believe that Participant has been exposed to a person with a confirmed or suspected case of COVID-19.

Relocating to British Columbia for Seasonal Training or Permanently for continued involvement in Athletics:
I attest that:

  • Participant agrees to completing all appropriate BC Athletics COVID-19 Waivers/Releases/Assumption of Risk/Questionnaire and Attestation.
  • Participant agrees when relocating for Seasonal Training or Permanently for continued involvement in Athletics, to Train Solo or Participate on their Own for a period of 14 days beginning from the first day they arrive in British Columbia.
  • Participant agrees to notify BC Athletics (Email: sam.collier@bcathletics.org or (604)-333-3556) on the first day they arrive in British Columbia.

I attest that:

  • Participant has not been diagnosed with COVID-19

OR

  • Participant has been diagnosed with COVID-19 and been cleared as noncontagious by provincial or local public health authorities (confirmation from a medical practitioner will be required and maintained in a confidential file by the organization)

I acknowledge and agree that Participant will follow recommended guidelines, laws and protocols of the Province of British Columbia, the Provincial Health Officer, the British Columbia Amateur Athletics Association, and BC Athletics Member Club/Training Groups in order to reduce the spread of COVID-19.

All Participants of the British Columbia Amateur Athletics Association agree to abide by the following points when entering training facilities and/or participating in club/training group activities under the COVID-19 Response plan and RTP Protocol:

  • Participant agrees to symptom screening checks and will let their club/training group know if they have experienced any of the symptoms in the last 14 days.
  • Participant agree to stay home if feeling sick and remain home for 14 days if experiencing COVID-19 symptoms.
  • Participant agrees to sanitize their hands upon entering and exiting the facility, with soap & water or sanitizer.
  • Participant agrees to sanitize the equipment (shared and personal equipment) they use throughout their practice with approved cleaning products provided by the club/training group.
  • Participant agrees to continue to follow social distancing protocols of staying at least 2m away from others.
  • Participant agrees to not share any equipment during practice times.
  • Participant agrees to abide by all of their Clubs/Training Group COVID-19 Policies and Guidelines.
  • Participant understands that if they do not abide by the aforementioned policies/guidelines that they may be asked to leave the club/training group for up to 14 days to help protect the participant and others around them.
  • Participant acknowledges that continued abuse of the policies and/or guidelines may result in the temporary suspension of their club membership.
  • Participant acknowledges that there are risks associated with entering training facilities and/or participating in club/training group activities, and that the measures taken by the club/training group and participants, including those set out above and under the COVID-19 Response Plan and Return to Sport Protocols, will not entirely eliminate those risks.

 


 

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

(To be executed by Participants over the Age of Majority)

  1. This is a binding legal agreement. Clarify any questions or concerns before signing.  In consideration of the opportunity to participate as a Participant in the spectating, orientation, instruction, training, participation in the sport of athletics, related athletics disciplines, activities, programs, travel to and from competitive events and associated non-competitive events, including the services of and offered (the “Activities”) by the British Columbia Amateur Athletics Association its respective, directors, officers, committee members, members, employees, coaches, volunteers, officials, participants, governing body, agents, sponsors, owners/operators of the facilities in which the Activities take place, and representatives (collectively the “Organization”) the undersigned, being the Participant, acknowledges and agrees to the following terms:

Description of Risks

  1. The Parties understands and acknowledges the following risks, dangers and hazards (the “Risks”) of the Activities and related disciplines which include, without limitation:

    1. Strenuous and demanding physical exertion, strenuous cardiovascular workouts, rapid movements, exertion and tension on various muscle groups which may cause serious injury to virtually all bones, joints, ligaments, muscles, tendons, organs and other aspects of the Participant’s body or the Participant’s general health and wellbeing.
    2. Concussion or other related head injuries including but not limited to closed head injury or blunt head trauma.
    3. Loss of or damage to equipment/property.
    4. Exposure to extreme conditions and circumstances.
    5. Contact with other participants, officials, administrators, employees, volunteers, spectators or other natural or manmade objects, dangers arising from adverse weather conditions, imperfect field of play conditions, equipment failure or malfunction, inadequate safety measures and participants of varying skill levels.
  1. The Activities have foreseeable and unforeseeable inherent risks, hazards and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, sickness, disease, contagion including but not limited to COVID-19, permanent disability, paralysis, loss of life.
  1. The Organization may offer or promote online programming (such as webinars, remote conferences, workshops and online training) which have different foreseeable and unforeseeable risks than in-person programming.
  1. The Parties understands that these Risks may be caused in whole or in part by the Participant’s own actions or inactions, the actions or inactions of others participating in or present during the Activities, or the negligent acts or omissions of the Organization, its employees and agents.

 

Terms and Attestation

  1. The Parties attests, acknowledges and agrees:
     
    1. That the Participant is in good physical and mental condition to participate in the Activities and does not have any undisclosed medical conditions.
    2. The Participant will comply with the rules and regulations for participation in the Activities including those that are a condition of use of the facility or venue in which the Activities occur.
    3. The Participant will comply with all rules and regulations of the Organization, Dominion of Canada, Province of British Columbia and Public Health concerning matters of health and safety and specifically as they relate to COVID-19 or such other communicable disease or contagion and further that in the event the Participant fails, in the sole determination of the Organization, to comply with any such rules and regulations or related protocols, the Participant may be removed from or prevented from participating in the Activities.
    4. If the Participant observes or experiences a significant hazard or risk, the Participant will remove themselves from participation in the Activities and report the hazard or risk to the attention of an Organization representative immediately.
    5. That the Organization does not undertake to provide health, accident, disability, hospitalization, personal property or other insurance for the Participant
    6. When the Participant practices or trains in the Participant’s own space, the Participant is responsible for the surroundings and the location and equipment that the Participant selects.
    7. That it is the Participant's sole responsibility to assess whether any Activities are too difficult or strenuous for the Participant. By the Participant commencing an Activity, the Parties acknowledge and accept the suitability and conditions of the Activity; and
    8. That the Participant is responsible for the choice of the Participant’s safety equipment, if required or recommended, and the secure fitting of the safety equipment.

 

Release of Liability and Waiver

  1. The Participant hereby expressly assumes all such Risks and responsibility for any damages, liabilities, losses including loss of income, expenses, or related loss which they incur as a result of the Participant’s participation in the Activities.
  2. The Participant waives any and all claims that they may have now or in the future against the Organization and covenant not to sue the Organization.
  3. The Participant forever releases the Organization from any and all claims, demands, actions, damages (including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which they have or may have in the future, that might arise out of, result from, or relate to participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Organization. That negligence includes failure on the part of the Organization to take reasonable steps to safeguard or protect the Participant from the risks, dangers and hazards associated with the Activities.
  4. The Participant agrees that if, despite this release and waiver of liability, assumption of risk and indemnity agreement, the Participant or anyone on the Participant’s behalf, makes a claim against the Organization or any third party that claims indemnification from the Organization, the Participant WILL INDEMNIFY, SAVE AND HOLD HARMLESS the Organization from any litigation expenses, legal fees, loss, liability, damage or costs which any may incur as a result of such claim, to the fullest extent permitted by law.

 

Jurisdiction

  1. The Participant agrees that in the event that they file a lawsuit against the Organization, they agree to do so solely in the Province of British Columbia Canada and further agree that the substantive law of the Province of British Columbia will apply without regard to conflict of law rules. The Participant further agrees that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

 

Acknowledgement

  1. I acknowledge that I have read and understand this Agreement, that I have executed this Agreement voluntarily, and that this Agreement is to be binding upon Participant, their heirs, spouse, children, parents, guardians, next of kin, executors, administrators and legal or personal representatives. The Participant further acknowledges by signing this Agreement that the Participant has waived the right to maintain a lawsuit against the Organization on the basis of any claims from which I have released herein.
