Waiver, Release, and Indemnity Agreement

Santa Fun Run Date of Event: NOV 30, 2025 Organizer: YQX Running Club (a Not-for-Profit organization) Location: Gander, NL

VERY IMPORTANT: PLEASE READ CAREFULLY!

THIS IS A LEGAL AGREEMENT. BY ELECTRONICALLY SIGNING, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

1. Assumption of Risk

I, the undersigned participant (and/or the parent/legal guardian of a dependent participant, hereinafter "the Participant"), acknowledge and agree that participation in the [Insert Charity Run Name] (the "Activity") involves inherent risks, dangers, and hazards. These risks include, but are not limited to:

• Physical exertion, fatigue, and illness, including medical conditions, heat stroke, or heart attack.
• Falls, contact with other participants, course officials, volunteers, spectators, or vehicles.
• The condition of the course, including, but not limited to, uneven pavement, potholes, curbs, debris, or weather conditions (e.g., ice, rain, wind, heat).
• Risks associated with the consumption of food or drink provided at the event.
• Risks associated with first aid, medical, or emergency treatment or transportation.

I voluntarily accept and assume all risks of injury, damage, or loss associated with my (or my dependent's) participation in the Activity, even if those risks are caused by the negligence or carelessness of the Organizer or its agents.

2. Waiver and Release of Liability

In consideration of the acceptance of my entry (or my dependent's entry) into the Activity and the permission to participate, I hereby waive, release, and forever discharge the Organizer, including its directors, officers, employees, agents, representatives, volunteers, sponsors, partners, and all persons acting on its behalf (collectively, the "Releasees"), from any and all claims, demands, damages, costs, and expenses (including legal fees), of any kind whatsoever and howsoever caused, arising out of or in connection with my (or my dependent's) participation in the Activity, even if the same may be attributed to the negligence, gross negligence, or any other action or inaction of any of the Releasees.

This waiver and release includes, but is not limited to, claims for:

• Personal injury, disability, death, or illness.
• Damage to or loss of personal property.

3. Indemnification/Hold Harmless

I agree to indemnify, defend, and hold harmless the Releasees from and against any and all liabilities, claims, demands, actions, causes of action, costs, and expenses (including legal fees) that may be brought against the Releasees by me, my dependent, my family, estate, heirs, or assigns, or by any third party (including another participant) arising out of or in connection with my (or my dependent's) participation in the Activity.

4. Health and Medical Consent

I certify that I (or my dependent) am physically fit and have not been advised otherwise by a qualified medical professional to participate in this Activity. I consent to and authorize the Organizer and its representatives to arrange for or administer medical treatment, first aid, or transportation in the event of any injury, illness, or medical emergency during the Activity, at my (or my dependent's) expense. I release the Releasees from all liability associated with such medical treatment.

5. Family Member/Dependent Clause (If applicable)

If I am signing on behalf of a minor or a dependent family member, I confirm that I am the parent or legal guardian with full legal authority to sign this Waiver on their behalf. I agree that the terms of this Waiver, Release, and Indemnity Agreement apply equally to the minor or dependent, and I further agree to indemnify and hold harmless the Releasees from any and all claims, damages, or liabilities made by or on behalf of the minor or dependent.

6. Publicity Release

I grant full permission to the Organizer and its partners to use any photographs, videotapes, recordings, or other records of the Activity, including my (or my dependent's) name, likeness, or voice, for any legitimate purpose, including event promotion and fundraising, without compensation.

7. Governing Law and Jurisdiction (Newfoundland and Labrador Legality Clause)

This Waiver, Release, and Indemnity Agreement shall be governed by and interpreted in accordance with the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable therein. I agree that any action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the courts of Newfoundland and Labrador.

8. Electronic Signature and Acknowledgement

I acknowledge that I have read this document in its entirety, understand the contents, and agree to the terms and conditions set forth above. I understand that by checking the box below and entering my name, I am providing a legally binding electronic signature.

I confirm that I have had sufficient opportunity to read and seek legal advice regarding this entire document before signing. I understand that this is a release of liability and a contract.
