Fort Henry’s Cannonball Crush Event - June 14^th, 2024

PLEASE READ CAREFULLY BEFORE SIGNING

In consideration of being permitted to participate in any way in the activities and obstacles of The Cannonball Crush Event (the “Event”), under the auspices of the St. Lawrence Parks Commission (the “SLPC”) at Fort Henry National Historic Site and CFB/DND Kingston (the “Site”), I understand, acknowledge, and agree as follows:

1. I certify that I am physically fit and know of no medical or health reason why I should not participate in the Event. The risks involved with participating in the Event are dependent upon many factors, including but not limited to: variations in steepness and terrain; rocks; trees and other forms of forest growth or debris (above or below the surface); bare spots and other forms of natural or man-made obstacles, as well as collisions with equipment, obstacles or other participants. I understand that there is a significant risk of injury associated with participation in the Event, including but not limited to permanent disability and death. I further understand that injuries are a common and ordinary occurrence in the Event; and,
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS OUTLINED IN THE PARAGRAPH ABOVE, both known and unknown, even if arising from the negligence of those persons released from liability below, and assume full responsibility for my participation in the Event; and,
3. I understand that the activities and obstacles of the Event are physically and mentally intense. I understand the rules and regulations for participating in the Event and agree that it is my responsibility to comply with any and all safety rules and regulations. I understand that failure to comply with these rules and regulations, or me engaging in any inappropriate behaviour that results in injury to me or other participants will be my responsibility; and,
4. I for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby forever release and discharge the SLPC, His Majesty the King in Right of Canada, His Majesty the King in Right of Ontario and their respective officers, directors, employees, volunteers, agents, sponsors, advertisers, promoters, organizers, and owners or lessors of the Site (collectively, the “Released Parties”) from assuming any responsibility or liability for any injury to me (including death) or loss or damage to my personal property arising out of, or in any way connected with my participation in the Event or in any other way connected to my use of the facilities at the Site, my own acts or negligence, or the acts or negligence of any of the Released Parties, or the acts or negligence of other participants; and,
5. I further agree to indemnify and hold harmless the Released Parties from and against any and all claims, demands, and causes of action, of any kind whatsoever, that may be made or initiated by, or on behalf of me arising out of or attributable to the Event or in any other way connected to my use of the facilities at the Site; and,
6. I understand and agree that this Release and Waiver of Liability agreement covers my use of the facilities at the Site, and each and every obstacle and activity of the Event in which I participate hereafter.

(a) For participants eighteen (18) years of age and over:

I have read this form after it was completed. I give this release and waiver voluntarily, and I understand and agree to be bound by its contents. By my signature following, I hereby grant my permission and authority to the staff officials at the Site to act on my behalf in the event of emergency, provided my emergency contact cannot first be reached by telephone at the number(s) listed below.

(b) For participants aged 13-17 years of age – to be completed by Parent/Guardian

I have read this form in its entirety. As a Parent/Guardian to the Participant as named below, I give this release and waiver voluntarily for my child, and I understand and agree to be bound by its contents. By my signature following, I hereby grant my permission and authority to the staff officials at the Site to act on my behalf in the event of emergency, provided my emergency contact cannot first be reached by telephone at the number(s) listed below.

*Please note that any personal information (including health information) is being collected in accordance with section 5(1) of the St. Lawrence Parks Commission Act, R.S.O. 1990, c.S.24, and only for the purposes of administering the Cannonball Crush, this release/indemnity and responding to an emergency.

With respect to photographs (digital or otherwise), slides, videos or audio recordings (the “Photographs”) taken of me or my participating child, by agents, employees or representatives of the St. Lawrence Parks Commission (the “SLPC”) on June 14, 2025 at the Site, in consideration of being permitted to participate in any way in the activities and obstacles of The Cannonball Crush Event (the “Event”), I, the undersigned, hereby irrevocably grant to the SLPC all rights of any kind, whether known or becoming known, in and to all Photographs of me or my participating child, my acts and appearances throughout the world forever by any known or later discovered means.

I hereby consent and authorize the SLPC to copy, exhibit, publish or distribute any and all such Photographs of me or my name for advertising, promotional or commercial purposes of any kind (including, but not limited to the SLPC brochures, the SLPC materials, and the SLPC or any Government of Ontario website) without any compensation.

I waive any right to inspect or approve the finished product, including the printed copy, wherein my likeness appears.

I hereby waive any and all moral rights which I may have with respect to the Photographs.

I hereby consent under the Freedom of Information and Protection of Privacy Act (Ontario) to the collection, use and disclosure of my image and name in relation to the Photographs.

I hereby hold harmless, release and forever discharge the SLPC, His Majesty the King in Right of Canada, His Majesty the King in Right of Ontario and their respective officers, directors, employees, volunteers, agents, sponsors, advertisers, promoters, organizers from all claims, demands and causes of action, including but not limited to libel and invasion of privacy, which I, my heirs, representatives, executors, administrators or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization. I understand that this release is irrevocable by me so that the SLPC may proceed in full reliance thereon.

I have read this form in its entirety. As the Parent/Guardian of the Participant noted above, I give this consent and release voluntarily and I understand and agree to be bound by its contents.
